First Approval of ABP Applications Post-Reopening Scheduled for February 17, 2022 ICC Meeting

The Illinois Power Agency (“IPA”) and the Program Administrator have identified February 17, 2022 as the first open meeting of the Illinois Commerce Commission at which the Program Administrator will submit ABP applications for ICC approval following Program reopening on December 14, 2021.  For applications to be eligible to be submitted for approval at the meeting, they must be Part I Verified prior to January 31, 2022. Projects in Need Information status as of January 31, 2022 will not be eligible to be submitted to the ICC. Note, all applications that were waitlisted prior to reopening on December 14, 2021 have been reviewed and are either Part I Verified or in Need Information status.

Approved Vendors are encouraged to manage their applications and batches so that they can meet their contractual obligations, which include signing any contracts within 7 business days of receipt from the contracting utility and posting the required collateral for all systems in a batch within 30 business days of ICC approval of that batch.

As a reminder, with the passage of Climate and Equitable Jobs Act (Public Act 102-0662), Approved Vendors may no longer elect to have collateral withheld from the first (or only, in the case of Small Distributed Generation systems) payment for an application. Approved Vendors may elect during the batching window to withhold an application from being submitted to the ICC up to two times. As a large number of systems will be eligible to be submitted to the Commission for the February 17, 2022 open meeting, Approved Vendors may consider using this option to manage the number of contract documents that they will be required to sign as well as the amount of collateral that they will be required to post at any given time. Following the February 17, 2022 meeting date, the Program Administrator will resume regular submissions of batches of eligible applications for ICC approval during their normally scheduled open meetings.
